Total number of foreign nationals in prison
Quarterly statistics from the Ministry of Justice show that, as at 31 March 2013 , there were 10,725 foreign nationals in prisons in England and Wales; as such, they represent 13% of the total prison population.


Foreign national prisoners affected by deportation action
A parliamentary written answer shows that as of 9 January 2012, 5,178 foreign national offenders serving a custodial sentence in England and Wales were being considered for deportation at the end of their sentence.

Given that annual statistics from the Ministry of Justice show that as at 30 June 2011, the total number of foreign nationals under an immediate custodial sentence in prisons in England and Wales stood at 7,516, deportation action can be seen to affect a significant majority of foreign national prisoners.

Between 2007 and 2010
, a total of 20,360 foreign national prisoners were deported from the UK
. In 2010, 5,235 foreign national prisoners were deported; in 2011, 4,649 foreign national offenders were removed or deported.

According to a parliamentary written answer, in 2011-12, 409 appeals against deportations were allowed. Of these, 177 were allowed on the grounds of Article 8 of the European Convention on Human Rights - the right to respect for private and family life.


Foreign nationals detained in prison post-sentence
No regular statistics are currently produced on the number of foreign nationals detained in prison under immigration powers following the completion of their custodial sentence: these detainees are not included in the quarterly statistics on detention issued by the Home Office.


However,
a freedom of information request submitted by DAS shows that the population of detainees held in the prison estate across 2011 and in early 2012 ranged from 457 (at the end of June 2011) to 610 (at the end of January 2011). At the end of January 2012, there were 595 foreign nationals being held in prison under immigration powers.

A subsequent freedom of information request shows that, between February and August 2012, the population of immigration detainees in prison ranged from 538 to 599. In August 2012 - the most recent month for which we have these figures - there were 572 foreign nationals being held in prison under immigration powers.

According to Home Office statistics, the total number of people in immigration detention facilities as at 30 June 2012 was 2,993; as such, those detained in prison can be seen to represent just under 20% of the overall detained population.
